Family Law Info

Family law refers to anything involving legal services that has to do with families. When people get divorced, they need to have the services of a family lawyer. This person helps them to divide the property fairly and settle disputes out of court of possible. Each spouse will need to have his/her own lawyer and the lawyers will deal with each other if the separation and divorce is not an amicable one. This eliminates the extra stress of having to argue things out in public.

Although some couples do not need to have two different lawyers because they agree to divorce and can solve the separation problems themselves. They only need to have a lawyer to make the divorce legal in court. However, if there are children involved family law looks after the children in deciding custody rights and the amount of payment needed by one of the parents to help pay the children’s expenses. Family law is not just for divorces, though. It may be used by grandparents who want access to their grandchildren or if children have been taken illegally by one of the parents.

Last Will and Testament

Everyone should make a will. It isn’t a morbid thing to do, and in fact is just plain commonsense to do to ensure WHAT you have goes to WHO you want to have it, in due time of course! Here are a few simple steps for you take:

Decide what to include in your will. To get started, list your major items - property, shares etc..

Keep in mind that if you’re married, each spouse makes a separate will. You can leave only your share of assets you own jointly with your spouse.

Divorce Myths

  1. One lawyer is a good as another. There is a tremendous difference between lawyers. Some are down to earth and some are distant and hostile. Some call you back the same day and others wait 5 days to call you. There are attorneys that only practice in divorce and marital law. Others are like a jack of all trades - they practice in divorce, criminal law, bankruptcy, etc. But remember the old saying - “Jack of all trades, master of none.” Look for a lawyer that has adequate skills for your situation. More important: look for a lawyer that matches your values and has the ability to communicate well with you.

  2. The mother always gets the kids. Not true anymore. Florida law now treats men and women alike when it comes to custody decisions. Many states are similar. Gender bias is slowly disappearing from marital law. Does this mean men get custody as often as women? You already know the answer to that - women still appear to get custody more often than men. But men should take heart because the law is now more of a level playing field for custody battles.

Divorce And Taxes

In Divorce, potential tax liability can frequently become the tool for one spouse to use against the other spouse. If improperly used, this tool can destroy all of the marital assets. In the worst case, tax liability can seriously impact the future financial security of either spouse and subject them to criminal sanctions.

Situation 1 - Your Spouse Owns a Business

The most common situation where taxes become an issue in a divorce is they there is a family business. The owner - spouse may have hidden cash receipts or engage in a practice of recording inflated expenses. This common practice by many business owners is a fraudulent attempt to minimize taxes. The other spouse is often aware of and approves of this practice. During the marriage, minimization of taxes results in higher household income and a better lifestyle for the couple.

After Divorce

The divorce is finally over.

No more fighting over who gets to keep the home and other real estate. Those leather couches, and the expensive art hanging on the walls of your summer home. A drop in the bucket compared to the company that both of you slaved over to build or the family pet that made your kids so happy. The whole process almost landed you in Bankruptcy Court. But even now, all that looks small compared to the most important issue of all: child custody. But hey–all of this is over. Resolved. Now you can breathe a sigh of relief. You’ve probably been wondering about your future - without your x. Yes, being single again definitely has its benefits. Maybe you’re going out more, enjoying life, and watching your diet. It’s those little things you haven’t enjoyed in a long time that suddenly make life worth living-again.

Finding a Family Lawyer

If you are in need of locating a good attorney, one who specializes in family law, then you need someone who can look after your interests as well as the interests of your children. I have listed five options to help you find the attorney who is right for you.

  1. Check with Friends, Family - People you know can be an excellent resource to help you locate a family law attorney. Somebody you know probably has been through a similar experience; their advice and support can be useful to you. 2. The Bar Association - A local or state bar association can be a wonderful resource as they will tell you which of their members specialize in Family Law. Get a hold of that list, contact the attorneys directly, and interview them. Typically, your first visit is free so that you can learn what the family law attorney will do for you, their fee structure, and much more.

Civil Partnership Act

The Civil Partnership Act 2004 came into force on the 5 December 2005 providing a long overdue legal recognition of same sex couples’ rights. Same sex couples now finally have largely the same legal rights as that of heterosexual married couples. However, there does appear to be 2 areas where the legal rights of civil partners and married couples differ.

Dissolution
The grounds for dissolving a civil partnership are the same as those for dissolving a marriage with one exception - adultery is not a ground for dissolution in a civil partnership unlike in marriage cases.
